The website www.mpothos.gr includes the online store, which is the online presence of the company under the name “MPOTHOS EVANGELOS & SIA OE”, based in El. Venizelou 82 (Grammou 82), Moschato (VAT 999780713).

 “BOTHOS EVANGELOS & SIA OE” makes effort to provide the most effective service to the company’s customers every day. The creation of this particular e-shop marks the beginning of an advanced form of communication between the company and our customers. The e-shopis addressed to all internet users who wish to receive immediate information on the products offered by our company in combination with the possibility of making purchases through the e-shop, following a remote online order, always under the subject to the adequacy of the company’s reserves. The present conditions are fully compatible with the current European and Greek law, while the users recognize the right of the company to change the provisions of these conditions, insofar as they do not concern binding legal obligations and without affecting completed situations. The user of the website acknowledges that he has read these terms, agrees with them and undertakes to comply with them. It is our obligation that the customer is always informed and assured. For this reason, we inform the customers of our online store about the following issues:

Α.PROTECTION OF PERSONAL DATA 

In order to carry out any transaction through the “EVANG. BOTHOS & SIA OE” in order to place orders for the company’s products, you will be asked to provide some of your personal information. When you place an order, we will ask you for your full name, the address to which the products will be shipped, your landline number (or any other phone number you prefer), your email address, and if you choose to have your payments are made via credit card, the number, the card’s expiry date and the three-digit security code. Β. SECURITY 

The website www.mpothos.gr uses the SSL protocol, for secure online commercial transactions. This encrypts all credit card information so that it cannot be read or changed in transit over the Internet. The SSL (Secure Sockets Layer) protocol is today the global standard on the internet for certifying websites to web users and for encrypting information between web users and web servers. An encrypted SSL communication requires that all information sent between a client and a server be encrypted by the sending software and decrypted by the receiving software, thus protecting personal information in transit. DATA PROTECTION: The creators of photographs as original works of the spirit in accordance with provision 2 § 1 of the Berne-Paris International Convention, of article 2 § 1 of Law 2121/1993, as currently in force, and of Directive 93/98 EC, have agreed to automatically transfer (according to Article 32 § 2 of Law 2121/93, as it currently applies) to the “Company” the property right and all of their powers over it in relation to each photo they will create and have accepted that the ” Company” will have the full exploitation of these works without restriction as well as the rights of modification, reproduction, integration and multiplication for its entire duration (Article 9 of the WIPO Treaty on Intellectual Property ratified by Greece with Law 3184/2003 – Official Gazette 228/26.09.2003, 12 of the TRIPS Agreement on Intellectual Property Rights in the Trade Sector, ratified by Greece with Law 2290/1995 [Official Gazette A’ 28] as well as Article 6 of Directive 93 /98.

D. ORDERING PRODUCTS AND CONSUMER PROTECTION

 Placing an order through the e-shop constitutes a distance sales contract regulated by the legislative framework of Law 2251/1994, as amended. You can place a valid order through the e-shop if you are legally competent in compliance with the articles of the Greek Civil Code, (as long as you have completed the eighteenth year of your age and are not legally bound to enter into a sales contract). Orders can also be placed by representatives of legal entities, while the company reserves the right to claim from the supervisor or guardian any orders that will be made by legally incompetent persons.

WARRANTY 

The products sold by the website www.mpothos.gr are new and unused, as received from the manufacturing companies. The duration and terms of each product’s warranty are detailed in the manufacturer’s brochure accompanying the product. In any case, the international, European and Greek Laws on e-commerce and consumer protection apply. The products are also accompanied by written instructions for use (except for easy-to-use products) and a two (2) year guarantee of proper operation, as required by law. Proof of warranty is the document you receive, retail receipt or invoice, which always includes the name and address of the guarantor, the product to which the warranty refers, its exact contents. 

The product warranty has a duration according to the manufacturer from the date of purchase and allows free repair of the problem, as long as the following conditions are met:

 • To have the warranty of the agency and proof of purchase of the product.

 • The product’s data (Serial No.) must not have been altered 

• The damage is not due to the fault of the consumer based on the   manufacturer’s correct operation form 

Reasons the product is not covered by the warranty 

• Normal product wear and tear. 

• The normal wear and tear of spare parts during use. 

• Damage caused in transit. 

• Damage from: – power outage – phase loss – voltage fluctuations – voltage supply other than that indicated by the manufacturer. 

• Non-compliant use of the machine. 

• Damage from incorrect use of the machine as well as from the wrong consumables used. 

• Damage caused by the use of parts, accessories or consumables not certified by the manufacturer. 

• Damage from accident, fire, extreme weather, etc.

 • Damage caused by improper storage or careless maintenance of a machine.

 • Damage caused by poor assembly or incorrect adjustment of the machine as stated in the user manual. 

• Damage or malfunction caused from improper cleaning of the machine from dust, oils, etc., as well as damage resulting from contact of the machine with chemical liquids.

PROCEDURE FOR PLACING AN ORDER VIA E-SHOP:

 1. Completing a special form with the necessary information to conclude the sales contract.

 2. Unreserved acceptance of the terms of the sales contract and the terms of use, with the electronic option “ACCEPT” given to the interested party by the website.

• By charging your credit card. Your credit card is charged on the day the products are shipped. www.mpothos.gr has taken all the necessary measures for the security of your transactions through your credit card and all credit card holders are subject to validity checks. It is important to mention a contact phone number and a valid e-mail address. 
• Cash on delivery (only for Greece) when you receive the products. 
• The consumer through the website is informed by the company before completing his order about the identity and address of the supplier, the essential characteristics of the product, the price, the quantity, the transport costs, the method of payment, delivery, the validity period and the price of the possible offer and the right of withdrawal. By sending the order form, the consumer receives a copy of the order online, which he can save. The prices listed in the relevant catalogs under each product include VAT (24%), while www.mpothos.gr reserves the right to adjust the prices without being obliged to inform the consumer.

CONSUMER RIGHTS 

WITHDRAWAL 

You have the right to return the entire order or part of it without having to tell us the reason why you wish to return the products, within a period of 14 working days from the date you receive it. In this case, you only bear the direct cost of returning the products. In the event that the reason for your return concerns an error by the company, we undertake to bear the cost of returning the product, as the 14 days only concern the withdrawal process and not the defective products for which the Legal Guarantee applies. To exercise the right of withdrawal, you are required to send the product in the perfect condition in which you received it, i.e. without its packaging having been tampered with and confirming that the product’s special markings have not been removed. In addition, you must include the retail receipt at the same time as submitting the withdrawal statement. Return will be accepted only after company approval. In the event of a return of the products and depending on the way you chose to pay for your order and the way they will be returned, your refund will be completed within 8 days from the date we receive the products. In the event that the reason for the return concerns an error on the part of the company, Bothos Evangelos & Co. OE undertakes to re-send the courier to the address you have specified for the receipt of the order at its own expense. In the event that the consumer wishes to return his order without the fault of the company, then the shipping costs are borne by the consumer himself. From the moment the product leaves you, Evag.Bothos & SIA OE receives it within 1-2 working days for returns within Greece and via ELTA courier. In the event that you choose other transport companies, we cannot provide any guarantee for the delivery times of the products you return to us. After we receive the product, we will immediately process your request and inform you by e-mail how to process it. Evag. Bothos & Co. OE, wanting to offer you the best possible service, gives you the right to submit any of your complaints electronically by filling out the relevant contact form that you will find here. 

 RIGHT OF REPLACEMENT

The company cannot provide a right of replacement. In case the consumer wants to change the respective product, he is obliged to return it to the company and make a new order. If the reason for the return is due to an error by the company, the return costs are borne by the latter.
